Since 31 March 2026 the heritage streets have been in the Housing Choice and Transport Zone (Amendment GC270), so the state-wide canopy rule below applies to their garden trees, by our reading.
A state-wide rule applies on top of that. In most residential zones (not Low Density Residential), Clause 52.37 needs a permit to remove, destroy or lop a canopy tree at least 5 m tall with a canopy averaging at least 4 m across. On a block with a house, that narrows to trees with any part of the trunk within 6 m of the narrowest street frontage or 4.5 m of the rear boundary. A dead tree is exempt. Look up your block on VicPlan, or ask the council, before you cut.
Scotchmans Creek
Scotchmans Creek forms Oakleigh’s northern edge, with a linear park and walking trail along it.
The SES lists Oakleigh among the places in Monash at risk of flooding, and names Atkinson Street, where it crosses Scotchmans Creek, as a flash-flood spot. If the skip goes on the road, Monash’s permit covers where it can sit.

Common questions
Can a skip go outside a shop in Oakleigh?
Only with a Monash permit, and in Oakleigh’s activity centre Monash allows a skip on the road only between 7am and 9am on weekdays. For a shop fit-out, a spot on private land, such as a rear car park, avoids that window.
